These Terms of Service (hereinafter referred to as "the Terms") constitute a legal agreement between you and us regarding the purchase and use of our apparel products and related services. Please carefully read and understand these Terms before visiting our website, purchasing products, or using related services. By accessing the website, placing an order, or using the services, you agree to fully accept all contents of these Terms, including any modifications we may make to them from time to time.
These Terms strictly comply with relevant laws and regulations such as the EU Consumer Rights Directive, the E-Commerce Directive, the General Data Protection Regulation (GDPR), and the Product Liability Directive, aiming to protect your legitimate rights and interests.
I Scope and Definitions
1.1 Scope of Application
These Terms apply to all EU Member State consumers who visit our official website (gioracollective.com), purchase clothing products from us through the website or other legal channels, and use our after-sales services (including returns, exchanges, repairs, and consultations).
1.2 Core Definitions
- "Consumer": refers to a natural person from an EU Member State who purchases our products for personal purposes rather than commercial or professional purposes.
- "Products": refers to all types of clothing and related accessories designed, manufactured, and sold by our company.
- "Order": refers to a request to purchase products submitted through our website or other channels.
- "Personal Data": refers to any information relating to an identified or identifiable natural person as defined under the GDPR.
II Product Information and Order Confirmation
2.1 Product Information Disclosure
We are committed to accurately, clearly, and completely disclosing the core information of each product on the website, including but not limited to: product name, style, material, size standard, color, price (including VAT), place of manufacture, washing and care instructions, inventory status, and delivery time. If a product has special design features or usage limitations, we will specify them.
Slight differences between product images and the actual product due to objective factors such as lighting during photography and monitor resolution do not constitute misrepresentation. We will strive to minimize such differences and will provide a notification on the website.
2.2 Order Submission and Confirmation
Before submitting your order, you should carefully verify the product information, shipping address, contact information, payment method, etc. After successful order submission, we will send you an order confirmation via email within 24 hours, confirming the order's validity, order number, and estimated shipping time.
If the order cannot be fulfilled due to product shortages, system malfunctions, or other force majeure events, we will immediately notify you and fully refund your payment without incurring any additional liability (except for cases caused by our intentional misconduct or gross negligence).
The contract is established upon your receipt of our order confirmation email. The order details are subject to our final confirmation. If you have any objections to the order confirmation information, you should contact us within 48 hours of receiving the confirmation email.
III Pricing and Payment
3.1 Pricing Standards
All product prices listed on our website include Value Added Tax (VAT) applicable in EU member states. Prices may be adjusted due to promotions, exchange rate fluctuations, or product updates. Adjusted prices will be updated on the website in real time and apply only to new orders placed after the adjustment.
If your country/region has additional customs duties or taxes, you are responsible for these costs. We will inform you of the relevant risks on the order page or confirmation email.
3.2 Payment Methods
We support payment methods including: credit cards (Visa, Mastercard, etc.), PayPal, and other payment channels that comply with EU payment security standards. You should make payments through the payment channels clearly stated on our website and never transfer money to any personal accounts.
You must ensure that your payment account information is accurate, valid, and has sufficient credit limit. If payment fails due to incorrect payment account information, insufficient credit limit, or a malfunction of the third-party payment platform, the order will be automatically invalidated, and we will not be held liable.
IV Delivery and Acceptance
4.1 Delivery Scope and Timeframe
We provide product delivery services within EU member states. The specific delivery area is as indicated on the website. Shipping costs will be calculated based on your shipping address, order weight, and selected shipping method, and will be displayed and borne by you upon order submission (except for items explicitly marked "free shipping" in promotional activities).
The estimated delivery period is 20-40 business days after order confirmation (may be extended to 10 business days for remote areas). In the event of delivery delays due to force majeure (such as natural disasters, customs inspections, logistics strikes, etc.), we will notify you promptly. The extended delivery time will be based on the notification. We will not be liable for late delivery penalties, but a full refund will be provided upon your request.
4.2 Acceptance and Objections
Upon receiving the products, you should immediately verify that the quantity, style, size, color, etc., match the order, and check for any obvious quality defects (such as damage, stains, loose threads, etc.).
If you find any discrepancies in quantity or obvious quality problems, you should contact us via email (sale@gioracollective.com) within 48 hours of receiving the goods, providing the order number, product photos, and a detailed explanation of your objection. We will verify your objection within 3 business days of receiving it and provide you with a return, exchange, or compensation solution based on the verification results.
If you do not raise any objection within 48 hours of receiving the goods, it will be deemed that you have confirmed that the product meets the order requirements and quality standards. Subsequent objections will not be accepted (except for hidden quality issues).
V Consumer Cancellation Right and Return/Exchange Policy
5.1 Consumer Cancellation Right
According to the EU Consumer Rights Directive, as a consumer, you have the right to unilaterally cancel your purchase contract with us within 14 calendar days of receiving the product without giving any reason. This period is calculated from the date you receive the product; if the order contains multiple products and they are delivered separately, the period is calculated from the date you receive the last product.
To exercise your cancellation right, you should send us a written cancellation notice via email (sale@gioracollective.com) within the above-mentioned period (you can use the standard cancellation template provided on the website), and return the product to our designated address within 14 calendar days of sending the cancellation notice.
5.2 Return and Exchange Conditions
- Products must be in brand new, unused condition, with tags and packaging intact, free from damage and stains, and not affecting resale.
- When returning products, please include the order number, invoice, and your contact information.
5.3 Refund and Shipping Costs
After receiving and inspecting the returned product, we will process a full refund (including the product price and shipping costs) within 7 business days. The refund will be returned to your original payment account, with the arrival time depending on the processing cycle of the payment platform or bank.
Return shipping costs for returns without a reason are your responsibility. If the return or exchange is due to product defects, incorrect delivery, or other reasons on our part, we will bear the return shipping costs. You can apply for reimbursement of shipping costs with valid logistics receipts.
VI Product Quality and Responsibility
6.1 Quality Standards
We promise that all products comply with relevant EU quality standards and safety regulations, are manufactured using the stated materials, and their processes conform to industry standards. The product warranty period is 6 months from the date you receive the product. During the warranty period, if the product has quality problems not caused by human factors (such as fabric tearing, stitching detachment, etc.), we will provide free repair, replacement with the same style product, or a full refund.
6.2 Product Liability
According to the EU Product Liability Directive, if our product is defective and causes personal injury or property damage to you or a third party, we will be liable without fault (you do not need to prove our negligence). You need to prove the following three points: the occurrence of actual damage, the existence of a product defect, and a causal relationship between the damage and the defect.
We are not liable for product liability in the following situations:
- The product defect is caused by improper use, washing, maintenance, or modification after you receive the product;
- The product complies with then-effective EU or member state mandatory regulations, and the defect is caused by compliance with those regulations;
- The defect was not detectable at the time the product was placed on the market, based on the scientific and technological level at that time.
The claim period for product liability is 3 years from the date you discover or should have discovered the damage, the product defect, and our identity; 10 years after the product was placed on the market, we will no longer be liable for product liability.
VII Personal Data Protection
7.1 Data Collection and Use
We strictly comply with GDPR regulations and collect your necessary personal data, including but not limited to your name, contact information, shipping address, and payment information, solely for legitimate purposes such as order processing, product delivery, after-sales service, and market research.

7.2 Data Rights and Protection

VIII Intellectual Property
All content on our website (including but not limited to product designs, images, text descriptions, trademarks, logos, etc.) is protected by EU intellectual property law, and the intellectual property rights belong to us or the relevant rights holders.
You only have the right to display or wear the products for personal use after purchasing them. You may not copy, disseminate, modify, or sell our product designs or website content without authorization, nor infringe upon our trademark rights, copyrights, or other intellectual property rights. Otherwise, we will pursue your legal liability.
IX Disclaimer and Limitation of Liability
9.1 Exemption from Liability
We shall not be liable for any inability to fulfill our obligations under these terms due to force majeure (such as natural disasters, war, strikes, government bans, etc.), but we shall promptly notify you and take reasonable measures to mitigate losses.
You shall be solely responsible for any product delays, losses, or damages caused by your own reasons (such as providing an incorrect delivery address or contact information, or failing to sign for the package in a timely manner).
9.2 Limitation of Liability
Except for the liability for damages expressly provided in these Terms, we shall not be liable for any indirect losses (such as loss of profits, loss of goodwill, etc.) arising from the use of our products or services.
In no event shall our total liability for damages arising from these Terms exceed the total price of the products in your corresponding order.
X. Amendment and Notification of Terms
We reserve the right to amend these Terms from time to time in accordance with updates to EU laws and regulations or business adjustments. The amended terms will be published on our official website (gioracollective.com) and will take effect immediately upon publication.
If the amendments involve your core rights, we will notify you by email 30 days prior to the amendments taking effect. If you do not object within 30 days of receiving the notification, you will be deemed to have accepted the amended terms; if you do not agree to the amendments, you may cease using our products and services.
XI. Dispute Resolution and Governing Law
11.1 Governing Law
These Terms shall be governed by applicable EU laws and regulations and the domestic law of your EU member state.
11.2 Dispute Resolution
Any dispute arising between you and us due to these Terms shall first be resolved amicably through negotiation. If negotiation fails, you have the right to apply for mediation to the consumer dispute resolution body of your Member State or to bring proceedings in a court with competent jurisdiction.
According to relevant EU regulations, you may also submit a dispute resolution request through the EU Online Dispute Resolution Platform (ODR platform).
XII. Miscellaneous
The invalidity or unenforceability of any provision of these Terms shall not affect the validity of the remaining provisions.
